Acuerdo de consentimiento y relevo de responsabilidad<\/h3>\r\n<h2>Favor de leer completamente el acuerdo de consentimiento y relevo de responsabilidad a continuaci\u00f3n antes de aceptar y pagar.<\/h2><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">El Participante que se identifica a continuaci\u00f3n (el \u00abParticipante\u00bb) desea participar en la Liga de LEGO STEM y Rob\u00f3tica en Colegio Sonifel (el \u00abPrograma\u00bb).<\/span><\/p><\/ul> \r\n<ul><p><span style=\"font-size: 75%;\">Como contraprestaci\u00f3n por permitir al Participante participar en el Programa y como condici\u00f3n para ello, Eureka Enrichment Services, Inc. (\u201cEureka\u201d) exige que el Participante y sus padres\/tutores legales se comprometan a cumplir con los t\u00e9rminos de este Acuerdo de consentimiento para participar y liberaci\u00f3n de responsabilidad (el \u00abAcuerdo\u00bb). <strong>Favor de leer todo el acuerdo a continuaci\u00f3n antes de aceptarlo.<\/strong><\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">El padre\/madre\/tutor del Participante entiende que la participaci\u00f3n en el Programa es voluntaria. Con la intenci\u00f3n de quedar legalmente vinculado, el padre\/madre o los tutores legales del Participante celebran este Acuerdo de manera deliberada y voluntaria en su propio nombre y en el de sus representantes personales, herederos y familiares. Las referencias a un \u00abParticipante\u00bb en este Acuerdo incluyen al padre\/la madre o a los tutores legales del Participante, salvo que se indique lo contrario. <\/span><\/p><\/ul>\r\n\r\n<ul><p><span style=\"font-size: 75%;\"><strong>1. Asunci\u00f3n de riesgos: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">(a) El Participante y el padre\/madre o tutor del Participante entienden que la participaci\u00f3n en el Programa podr\u00eda exponerlo a riesgos de lesiones y enfermedades, incluidas, a modo de ejemplo, lesiones y enfermedades provocadas por COVID-19 (ver a continuaci\u00f3n) o otras enfermedades infecciosas y otras actividades asociadas con la participaci\u00f3n en el Programa. <\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">(b) COVID-19. El Participante y el padre\/madre o tutor del Participante entiende y acepta que la participaci\u00f3n en el Programa presenta ciertos riesgos y peligros para el Participante, tanto graves como menores, como consecuencia de la exposici\u00f3n al virus de la COVID-19. La COVID-19 es una enfermedad provocada por el virus SARS-CoV-2, declarada pandemia global por la Organizaci\u00f3n Mundial de la Salud. El Participante entiende que la COVID-19 se considera una enfermedad altamente contagiosa y que se transmite principalmente de persona a persona, incluso por personas asintom\u00e1ticas. La COVID-19 tiene m\u00e1s probabilidades de propagarse cuando las personas mantienen un contacto cercano entre s\u00ed. El Participante entiende que, mientras participa en un Programa, el Participante estar\u00e1 en contacto cercano con otras personas, algunas de las cuales podr\u00edan estar infectadas por el virus y podr\u00edan contagiar la COVID-19.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">El Participante y el padre\/madre o tutor del Participante entienden y reconocen que, dada la naturaleza desconocida de la COVID-19, no es posible hacer una lista exhaustiva de cada uno de los riesgos de contraer la enfermedad. Sin embargo, algunos de los riesgos m\u00e1s frecuentes incluyen consecuencias para la salud, lesiones personales, enfermedades, discapacidad permanente e incluso la muerte, y pueden abarcar tos, falta de aire, dificultad para respirar, fiebre, escalofr\u00edos, temblores, dolor muscular, dolor de cabeza, dolor de garganta, p\u00e9rdida del gusto, etc. (\u00abExposici\u00f3n a la COVID-19\u00bb).<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">El Participante entiende y reconoce que los riesgos de COVID-19 son inherentes a la participaci\u00f3n en un Programa y que el Participante puede contraer COVID-19 como resultado de su participaci\u00f3n en un Programa. El Participante acepta que asume conscientemente el riesgo de toda y cualquier exposici\u00f3n a la COVID-19. El Participante y el padre\/madre o tutor del Participante entienden y aceptan que este Acuerdo incluye una liberaci\u00f3n de responsabilidad y renuncia al derecho a presentar todo y cualquier tipo de reclamos relacionados con la exposici\u00f3n a la COVID-19, as\u00ed como todo y cualquier tipo de reclamos por lesiones, discapacidad o enfermedades resultantes, incluida la muerte.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>2. Participaci\u00f3n sin s\u00edntomas de COVID-19: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">El Participante acepta que no participar\u00e1 en persona en el Programa si \u00e9l o cualquier persona que reside en la misma vivienda que el Participante ha tenido s\u00edntomas de COVID-19 durante los 14 d\u00edas anteriores a la fecha de participaci\u00f3n o ha tenido un resultado positivo en una prueba de COVID-19. Este requisito se aplica independientemente del estado de vacunaci\u00f3n del Participante, salvo que las autoridades de salud p\u00fablica emitan pautas actualizadas con respecto a la transmisibilidad de la COVID-19 por parte de personas completamente vacunadas y hasta tanto se emitan tales pautas. El Participante cumplir\u00e1 con las pruebas de detecci\u00f3n de COVID-19 o las pr\u00e1cticas de control de exposici\u00f3n al virus que podr\u00eda adoptar Eureka como requisito para participar en el Programa y tambi\u00e9n cumplir\u00e1 con los requisitos relacionados con la COVID-19 del estado o jurisdicci\u00f3n local en la que se ubica el Programa.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>3. Liberaci\u00f3n de todos los reclamos: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">En contraprestaci\u00f3n por la participaci\u00f3n voluntaria del Participante en los Programas, el padre\/madre o tutor del Participante asume la totalidad del riesgo de dicha participaci\u00f3n y, por la presente, libera a FIRST, Eureka y a sus directores, funcionarios, empleados, otros participantes y agentes (\u00abPartes Liberadas\u00bb) de todo reclamo, juicio, responsabilidad, acci\u00f3n y pretensi\u00f3n, por ejemplo, reclamos por culpa atribuida a las Partes Liberadas, que el Participante o sus herederos legales, representantes, sucesores, curadores y cesionarios tengan o puedan tener en el futuro y que surjan directa o indirectamente de la participaci\u00f3n del Participante en el Programa. Esta liberaci\u00f3n abarca cualquier p\u00e9rdida o da\u00f1o material o personal, o cualquier otra p\u00e9rdida provocada o supuestamente provocada, en todo o en parte, por culpa leve (pero no por culpa grave ni dolo) de las Partes Liberadas.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>4. Indemnizaci\u00f3n: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">El Participante y su padre\/madre o tutor acepta indemnizar a las Partes Liberadas respecto de todo reclamo, juicio, acci\u00f3n y pretensi\u00f3n, por ejemplo, reclamos por culpa, y otras responsabilidades, como honorarios de abogados, planteados por cualquier persona y que surjan o sean consecuencia directa o indirecta de la participaci\u00f3n del Participante en el Programa, incluidos, a modo de ejemplo, lesiones personales o da\u00f1os a la propiedad personal provocados por el Participante.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>5. Compromiso de no iniciar acciones legales: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">El Participante y el padre\/madre o tutor del Participante se comprometen a no plantear nunca, en forma directa ni indirecta, ning\u00fan juicio, acusaci\u00f3n, demanda, reclamo, queja ni pretensi\u00f3n en el marco del sistema legal, del sistema de equidad ni de otra manera en sede judicial ni en virtud de un sistema o procedimiento arbitral, contra las Partes Liberadas, que surja de la participaci\u00f3n del Participante en el Programa.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>6. Consentimiento para la grabaci\u00f3n y recopilaci\u00f3n de datos que le identifiquen personalmente y propiedad de las grabaciones: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">(a) El padre\/madre o tutor del Participante entiende que es posible que se hagan transmisiones en vivo, fotograf\u00edas, filmaciones y otro tipo de grabaciones (en conjunto, las \u00abGrabaciones\u00bb) de los participantes del Programa, incluso del Participante. El padre\/madre o tutor del Participante presta su consentimiento para la realizaci\u00f3n de dichas transmisiones, fotograf\u00edas, filmaciones y otras grabaciones, y para su uso (i) como parte de un registro del Programa y (ii) para promover p\u00fablicamente a Eureka, FIRST y sus Programas.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">(b) El padre\/madre o tutor del Participante entiende que Eureka es el \u00fanico y exclusivo propietario de todos los derechos personales, reales y el dominio sobre las Grabaciones, incluidos todos los derechos de autor y otros derechos de propiedad intelectual, y que no tendr\u00e1 derecho a revisar y aprobar tales Grabaciones antes de que se utilicen o divulguen.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">(c) El padre\/madre o tutor del Participante presta su consentimiento para la recopilaci\u00f3n y el procesamiento de datos que le identifiquen personalmente, de los tipos y para los fines que se expresen en la Pol\u00edtica de privacidad de FIRST. La Pol\u00edtica de privacidad de FIRST est\u00e1 disponible  <a href= \"https:\/\/www.firstinspires.org\/about\/privacy-policy\">aqu\u00ed<\/a> o puede solicitar una copia enviando un mensaje por correo electr\u00f3nico a Soporte del Equipo a <a href=\"mailto:customerservice@firstinspires.org\">customerservice@firstinspires.org<\/a>. El padre\/madre o tutor del Participante reconoce que ha le\u00eddo y comprende la Pol\u00edtica de privacidad de FIRST y presta su consentimiento afirmativo con respecto a ella.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>7. Totalidad del Acuerdo\/Ausencia de dispensa: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">Este Acuerdo representa la totalidad del acuerdo entre las partes con respecto a las cuestiones establecidas en el presente instrumento y reemplaza y deja sin efecto cualquier otro acuerdo o entendimiento, sea verbal o escrito, y solo puede modificarse si media la aceptaci\u00f3n y refrendaci\u00f3n de un representante autorizado de Eureka por escrito. La dispensa de una obligaci\u00f3n de una de las partes del Acuerdo por la otra parte no se interpretar\u00e1 como una dispensa de otras obligaciones o de la misma obligaci\u00f3n en el futuro.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>8. Divisibilidad y ejemplares: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">Los t\u00e9rminos de este Acuerdo son independientes entre s\u00ed. Si un t\u00e9rmino del Acuerdo se considera inexigible por parte de un juez, los t\u00e9rminos restantes continuar\u00e1n plenamente vigentes. Pueden suscribirse varias copias de este Acuerdo, todas las cuales constituir\u00e1n un \u00fanico y mismo acuerdo.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>9. Jurisdicci\u00f3n: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">El padre\/madre o tutor del Participante reconoce y acepta que la validez, efecto y funcionamiento de este Acuerdo se determinar\u00e1n de conformidad con las leyes de Puerto Rico (pero no con sus normas sobre conflicto de leyes), y acepta someterse a la jurisdicci\u00f3n de los juzgados estatales y federales con asiento en Puerto Rico. <\/span><\/p><\/ul><\/div><\/div><\/div><div id=\"wpforms-4117-field_80-container\" class=\"wpforms-field wpforms-field-html wpforms-conditional-field wpforms-conditional-show\" data-field-type=\"html\" data-field-id=\"80\" style=\"display:none;\"><div id=\"wpforms-4117-field_80\"><ul><p><span style=\"font-size: 100%;\">El padre\/madre o tutor del Participante ha le\u00eddo este Acuerdo y entiende que este incluye una liberaci\u00f3n de responsabilidad y renuncia al derecho a presentar reclamos por lesiones o da\u00f1os (seg\u00fan se describe m\u00e1s abajo) y que constituye una disposici\u00f3n legalmente vinculante.<\/span><\/p><\/ul>\r\n<ul><p>Al firmar a continuaci\u00f3n, el padre\/madre o tutor del Participante reconoce que ha le\u00eddo y que comprende este Acuerdo de consentimiento para participar y liberaci\u00f3n de responsabilidad y que se compromete a cumplirlo.<\/p><\/ul>\r\n<\/div><\/div><div id=\"wpforms-4117-field_81-container\" class=\"wpforms-field wpforms-field-html wpforms-conditional-field wpforms-conditional-show\" data-field-type=\"html\" data-field-id=\"81\" style=\"display:none;\"><div id=\"wpforms-4117-field_81\"><div style=\"height:250px;overflow:scroll;padding:5px;color:#714D03;border:4px double #DEBB07;\"><ul><h3>1. Consent &#038; Release Form<\/h3>\r\n<h2>Please fully read the Consent &#038; Release Agreement below before accepting &#038; proceeding to pay.<\/h2><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">The Participant identified below (\u201cParticipant\u201d) desires to participate as a member in the LEGO STEM &#038; Robotics League (\u201cProgram\u201d) at Colegio Sonifel. <\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">In consideration of and as a condition of allowing Participant to participate in the Program, Eureka Enrichment Services, Inc. (\u201cEureka\u201d) requires that the Participant\u2019s parent or legal guardian agree to the terms of this Consent to Participate and Release Agreement (the \u201cAgreement\u201d). <strong>Please read and scroll to the bottom to before accepting this Agreement. <\/strong><\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">The Participant\u2019s parent\/legal guardian understands that participation in the Program is voluntary. Intending to be legally bound, Participant\u2019s parent or legal guardian knowingly and voluntarily execute this Agreement on behalf of the Participant. References to \u201cParticipant\u201d in this Agreement include the Participant\u2019s parents or legal guardians unless otherwise noted. <\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>1. Assumption of Risk: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">(a) Participant&#8217;s Parents\/Guardians understand that participation in the Program may expose Participant to risks of injury and illness including, without limitation, injury and illness resulting from COVID-19 (see below) and other infectious diseases and other activities associated with participation in the Program. <\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">(b) COVID-19. The Participant and his\/her Parents\/Guardians understand and agree that participation in the Program presents certain risks and dangers to Participant, both serious and minor, arising from being exposed to the COVID-19 virus. COVID-19 is a disease caused by the virus SARS-CoV-2, declared by the World Health Organization to be a global pandemic. The Participant and his\/her Parents\/Guardians understand that COVID-19 is considered highly contagious and is primarily spread from person-to-person, including by asymptomatic persons. COVID-19 is more likely to spread when people are in close proximity to one another. The Participant and his\/her Parents\/Guardians understand that, while participating in the Program, the Participant will be in close proximity to other persons, some of whom may be infected by, and able to spread, COVID-19.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">The Participant and his\/her Parents\/Guardians understand and acknowledge that, given the unknown nature of COVID-19, it is not possible to fully list each and every risk of contracting COVID-19. Nevertheless, some of the generally understood risks include health consequences, personal injury, illness, permanent disability and even death, and may include coughing, shortness of breath, difficulty breathing, fever, chills, shaking, muscle pain, headache, sore throat, loss of taste or smell, pain or pressure in the chest, confusion, upper respiratory distress syndrome, pediatric multi-system inflammatory syndrome, and other symptoms and risks (\u201cCOVID-19 Exposure\u201d).<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">The Participant and his\/her Parents\/Guardians understand and appreciate that COVID-19 risks are inherent in participating in the Program and that the Participant may contract COVID-19 as a result of participating in the Program. The Participant and his\/her Parents\/Guardians agree that the Participant knowingly assumes the risk of any and all COVID-19 Exposure. The Participant and his\/her Parents\/Guardians understand and agree that this Agreement waives and releases the right to make any and all claims whatsoever related to COVID-19 Exposure and any and all claims for any resulting injury, disability, or illness up to and including death.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>2. COVID-19 Symptom-Free Participation: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">The Participant and his\/her Parents\/Guardians agree that the Participant will not participate in person in the Program if the Participant or any individual residing in the same home as the Participant has had any symptoms of COVID-19 during the 14 days preceding the date of participation or has tested positive for COVID-19. This requirement applies regardless of the vaccine status of the Participant unless and until guidance is updated by public health authorities regarding the transmissibility of COVID-19 by individuals who have been fully vaccinated. The Participant will comply with any COVID-19 screening or exposure control practices which may be adopted by FIRST when participating in the Program and will also comply with any COVID-19 requirements of the state or local jurisdiction in which the Program is located.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>3. Release of All Claims:<\/strong><\/span><\/p> \r\n<p><span style=\"font-size: 75%;\">In consideration for Participant\u2019s voluntary participation in the Program, the Participant\u2019s Parent\/Guardian assumes all risk of such participation and hereby releases FIRST, Eureka and its directors, officers, employees, other participants, and agents (\u201cReleasees\u201d) from any and all claims, suits, liabilities, actions, and causes of action, including but not limited to claims of negligence on the part of the Releasees, which Participant, or his\/her legal heirs, representatives, successors, conservators and assigns may have, now or in the future, which arise directly or indirectly from the Participant\u2019s participation in the Program. This release covers any property or personal loss or damage or other loss caused or alleged to be caused, in whole or in part, by the ordinary negligence (but not gross negligence or intentional wrongdoing) of the Releasees.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>4. Indemnification: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">Participant and the Parents\/Guardians agree to indemnify Releasees from and against any and all claims, suits, actions, causes of action including, but not limited to, claims of negligence, and any other liabilities, including attorneys\u2019 fees by any person arising out of, or resulting directly or indirectly from the Participant\u2019s participation in the Program, including, but not limited to, damage to personal property caused by the Participant or injury of any person caused by the Participant.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>5. Covenant Not to Sue: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">The Participant and the Parents\/Guardians agree that he\/she shall never institute or cause to be instituted, any suit, charge, demand, claim, complaint, or cause of action, in law, in equity, or otherwise, in any court, or in any arbitration system or procedure, against the Releasees arising out of the Participant\u2019s participation in the Program.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>6. Consent to Record and Collect Personally Identifiable Information, and Ownership of Recordings: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">(a) The Participant and his\/her Parents\/Guardians understand that live broadcasts, photographs, videotapes, and other recordings (collectively the \u201cRecordings\u201d) may be made of participants in the Program, including the Participant. The Participant and his\/her Parents\/Guardians consent to those broadcasts, photographs, videotapes, and other recordings and the use thereof (i) as part of a record of the Program and (ii) to publicly promote Eureka, FIRST and the Program.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">(b) The Participant and his\/her Parents\/Guardians understand that Eureka is the sole and exclusive owner of all right, title and interest in the Recordings including all copyrights and other intellectual property rights and that the Participant will not have any right to review and approve any such Recording before it is used or disclosed.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\">(c) The Participant and the Parents\/Guardians consent to the collection and processing of personally identifiable data, of the types and for the purposes expressed in the FIRST Privacy Policy. The FIRST Privacy Policy is available <a href=\"https:\/\/www.firstinspires.org\/about\/privacy-policy\">here<\/a> or by requesting a copy by emailing Team Support at <a href=\"mailto:customerservice@firstinspires.org\">customerservice@firstinspires.org<\/a>. The Participant and the Parents\/Guardians acknowledge they have read, understand, and affirmatively consent to the FIRST Privacy Policy.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>7. Entire Agreement\/No Waiver: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">This Agreement represents the entire agreement between the parties with regard to the matters herein and supersedes any other agreement or understandings, whether written or oral, and cannot be changed unless agreed upon and signed by an authorized representative of Eureka in writing. Any waiver of any obligation of either party to the Agreement by the other party shall not be construed to be a waiver of any other obligations or the same obligation on a future occasion.<\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>8. Severability and Counterparts: <\/strong><\/span><\/p>\r\n<p><span style=\"font-size: 75%;\">The terms of this Agreement are independent of each other. If a term in the Agreement is deemed unenforceable by a court, the remaining terms shall remain in full force and effect. Multiple copies of this Agreement may be signed, all of which constitute one and the same agreement.<p><\/p><\/span><\/p><\/ul>\r\n<ul><p><span style=\"font-size: 75%;\"><strong>9.
